The Meteorological Office v Edgar: EAT 14 Jun 2001

The employee alleged harassment and bullying against a more senior officer. After an investigation and appeal, the respondent found against the applicant, and withdrew his work on the television. He complained that he had been made subject to detrimental treatment for making a protected disclosure. The employer said that the events of which he had complained had taken place before the Act came into effect, and the Act not being retrospective, the disclosure was not protected, and the tribunal had no jurisdiction. The court held that there was no requirement that the acts should have occurred after the Act came into effect. No injustice had fallen on the employer, and the tribunal had jurisdiction.
