Employment Tribunal rejected claim and refused review. Appeal upheld. Tribunal ought to have accepted the claim; it was not open to it to conclude that it was clear that it did not have power to consider the claim. Also, it could be inferred that claimant’s position was that he had been employed for at least the qualifying period.
