ICO The complainant has requested information relating to a complaint he made about a specific restaurant to Wirral Metropolitan Borough Council’s (‘the Council’) Trading Standards department. The Council refused the request on the basis of section 30(1) of the FOIA as the information was part of an investigatory process. The Commissioner’s decision is that the Council has correctly applied the provisions of section 30(1)(b) of the FOIA and the public interest favours maintaining the exemption. He requires no steps to be taken.
