Wiltshire Council (Decision Notice): ICO 15 Nov 2011

The complainant asked Wiltshire Council to provide information relating to honorarium payments to former staff of Kennet District Council. The public authority withheld the requested information using the exemption in section 40(2) (personal information) of the Freedom of Information Act. The Commissioner considers that section 40(2) was incorrectly applied in this case. The complaint is upheld and the public authority is required to disclose the withheld information. The public authority’s handling of the request also resulted in breaches of certain procedural requirements of the Act as identified in this Notice.
