Valuation Office Agency (Decision Notice): ICO 27 May 2010

The complainant made a request for the rating file of a named caravan site. The information requested was withheld under the exemptions at sections 40(2) (personal information), 44(1) (prohibitions on disclosure) and 42(2) (commercial interests) of the Freedom of information Act 2000; also, under the exceptions at 12(3) (personal data), 12(5)(d) (confidentiality of proceedings) and 12(5)(e) (confidentiality of a legitimate economic interest) of the Environmental Information Regulations 2004 (‘the Regulations’?). During his investigation the public authority released some information. The Commissioner’s decision is that section 44 of the Act was correctly applied to the remaining information. The complaint is not upheld.
