The complainant requested information from Uttlesford District Council (‘UDC’) relating to planning data and communications. By the date of this notice UDC had failed to provide a substantive response to this request. The Commissioner’s decision is that UDC has breached regulation 5(2) of the EIR in that it failed to provide a valid response to the request within the statuary timeframe of 20 working days. The Commissioner requires UDC to respond to the complainant’s response in accordance with the EIR. UDC must take these steps within 35 calendar days of the date of this decision notice.
