Transport for London (Decision Notice) FS50423735: ICO 9 Jan 2013

The complainant has requested information relating to an investigation into allegations of wrong doing, made by the complainant, as well as Transport for London’s (TfL) policies on reporting wrong doing and fraud. TfL provided the complainant with some of the requested information but refused to disclose some information under section 30(1)(a), section 30(2)(a)(i), section 31(1)(g) with subsection 2(b), section 40(1), section 40(2), section 41 and section 42 of the Freedom of Information Act 2000 (FOIA). The Commissioner’s decision is that TfL has correctly applied section 40(1), section 40(2) and section 42 FOIA to part of the withheld information. However he has not upheld TfL’s application of section 30 and section 31 to the remaining parts of the withheld information. The Commissioner requires the public authority to disclose all information which has not been redacted under section 40(1), 40(2) and 42. TfL should not however disclose the anonymous letters as the Commissioner considers that these should have been withheld under section 40(2).
