Thames Valley Police confirmed it held information within the scope of the request but refused to provide it, citing sections 31(1)(a) and (b) (law enforcement) and 38(1)(a) and (b) (health and safety) of the FOIA. The Commissioner investigated its application of sections 31 and 38. She finds that neither section is engaged and therefore Thames Valley Police is not entitled to rely on either exemption.
