Stockport Metropolitan Borough Council (Decision Notice): ICO 31 May 2011

The complainant requested information relating to the monitoring of children with special educational needs. This was refused under section 12 of the Freedom of Information Act 2000, on the grounds of the cost for compliance. The complainant submitted refined requests for information which the public authority stated it did not hold. The Commissioner’s decision is that, with the exception of one item, the public authority does not hold the requested information. In failing to confirm that information was held, the public authority breached section 1(1)(a) of the Act, and in failing to disclose that information within 20 working days, the public authority breached section 10(1) of the Act.
