Sedgemoor District Council (Decision Notice): ICO 22 Jul 2013

The complainant has requested all documents relating to land and property owned or previously owned by Sedgemoor District Council in an area of specified land since 1974. The council refused to provide the information citing section 12 of the Freedom of Information Act 2000, on the basis that the cost of complying would exceed the appropriate limit. The Commissioner’s decision is that the council has correctly applied section 12 of the FOIA. The Commissioner is also satisfied that advice and assistance has been duly provided under section 16 of the FOIA, and that the time for compliance specified within section 10 of the FOIA has been adhered to. The Commissioner does not require any steps to be taken.
