ICO The complainant has requested a copy of the ‘Contemporaneous Notes’ taken during the Finance Inspection of a named residential care home in 2012 and 2013. The Regulation and Quality Improvement Authority (RQIA) refused to provide the requested information under section 36(2)(b)(i) and (ii) and section 36(2)(c) of the Freedom of Information Act 2000 (FOIA). The Commissioner’s decision is that the RQIA has correctly applied section 36(2)(b)(ii) FOIA and that section 40(1) FOIA should also have been applied to some of the withheld information. The Commissioner requires no steps to be taken.
