Regina v Pells Attorney-General’s Reference (No 92 of 2003): CACD 22 Mar 2004

Appeal was made against a sentence thought unduly lenient. The defendant was convicted of a racially aggravated assault occasioning actual bodily harm.
Held: There should be a serious increase in the penalty where a crime is racially aggravated, but this was not to be a calculation derived from the new maximum penalties.
