Regina v Hardy; Attorney General’s Reference (No 1 of 2007): CACD 7 Mar 2007

The Attorney General appealed sentences for misfeasance in a public office. The defendants were police officers who had unlawfully used access to the police national computer, and had been sentenced to 28 weeks imprisonment suspended.
Held: The offence left no alternative to an immediate custodial sentence. The defendant must have known that the result of his actions would be violence against a third party. Having completed part of the sentence, a nine month sentence of imprisonment was substituted.
