Regina v Baldwin: CACD 29 Oct 2002

The defendant appealed a sentence of imprisonment.
Held: The defendant was capable of earning a living. He had served a year of a two year sentence for supplying drugs. An immediate sentence had been appropriate, but he had shown he need not be in danger of re-offending. In view of current overcrowding in prisons, fines should now be used rather more than had recently been the case, and his sentence was adjusted accordingly.
