Porter v Porter: CA 1969

In ancillary relief applications, the discretionary powers enable the court to take into account ‘the human outlook of the period in which they make their decisions’. In the exercise of these discretions ‘the law is a living thing moving with the times and not a creature of dead or moribund ways of thought.’
