The applicants complained they were required to pay school fees as a result of their Kazakh nationality and immigration status.
Held: ‘… [A state] may also, in certain circumstances, justifiably differentiate between different categories of aliens residing in its territory. For instance, the preferential treatment of nationals of member states of the European Union – some of whom were exempted from school fees when Bulgaria acceded to the Union – may be said to be based on an objective and reasonable justification because the Union forms a special legal order, which has, moreover, established its own citizenship.’
