Pickering v Liverpool Post: HL 1991

Lord Bridge said: ‘It is not, of course, possible to determine in advance what kind of public comment on pending proceedings would create a substantial risk on the course of justice will be seriously impeded or prejudiced. That is one reason why it is not commonly possible, save in . . exceptional circumstances . .to restrain, by injunction a threatened contempt in breach of the strict liability rule. But editors and publishers will be well advised to exercise great care and not to overstep the mark in this regard.’
