Petrologic Capital Sa v Banque Cantonale De Geneve and Another: ComC 8 Mar 2012

Application by the first defendant, Banque Cantonale de Geneve (‘the bank’), for an order declaring that the English court does not have jurisdiction to hear the claimant’s claim against it. That claim is for an injunction to restrain the bank from paying out under a letter of credit which the bank issued at the request of the claimant, and for an order that the bank be required to pay to the claimant euros 2,385,506.33, that being the sum which the claimant describes (not altogether accurately) as currently held by the bank under the letter of credit.
