The complainant requested, under the Freedom of Information Act 2000, information about the consideration of complaints that he and his daughter had submitted to the PHSO. He did not receive all the information that he requested. The complainant referred the case to the Commissioner and narrowed his complaint to consider the recorded information about the involvement of any of the PHSO’s Directors with the complaints. The Commissioner found that the PHSO had failed to clearly indicate what recorded information it held or provide it and that it had breached section 1(1)(b). During the course of his investigation, the PHSO provided the relevant information that was held to the complainant. The complainant also asked the Commissioner to consider the PHSO’s compliance with section 10(1) of the Act. The Commissioner has found that the PHSO breached section 10(1) because it failed to comply with section 1(1) in twenty working days. He does not require remedial steps to be taken in this case. Information Tribunal appeal EA/2011/0165 struck out.
