Nottingham City Homes Ltd (Decision Notice): ICO 16 Dec 2010

The complainant asked Nottingham City Homes Limited (‘NCH’) to provide information about council tenancies in his immediate neighbourhood. NCH refused his request on the grounds that it believed the request to be vexatious and applied section 14(1) of the Freedom of Information Act 2000 (the ‘Act’). The Commissioner has considered the context and background leading up to this request and has decided that NCH was correct to refuse the request on the basis that it was vexatious under section 14(1) of the Act. The Commissioner also finds that the public authority breached section 17(1) of the Act in that it failed to provide a refusal notice to part of the request within 20 working days. Information Tribunal appeal EA/2011/0054 allowed.
