North Lancashire Teaching Primary Care Trust (Decision Notice): ICO 7 Apr 2011

The complainant made a request to North Lancashire Teaching Primary Care Trust for correspondence between the Chief Executive of the PCT and the Chief Executive of University Hospitals of Morecambe Bay NHS Trust. The PCT refused to provide this information to the complainant as it stated it was exempt from disclosure under section 31(1)(g) with section 31(2)(j) and that some of the information contained in the correspondence was also exempt under section 40(2) of the Freedom of Information Act 2000. During the course of the Commissioner’s investigation the PCT provided the complainant with some of the requested information. The Commissioner considers that the section 31(1)(g) with section 31(2)(j) exemption was correctly engaged in this case to the remaining withheld information. The Commissioner did not therefore go on to consider the PCT’s application of section 40(2). Information Tribunal appeal number EA/2011/0119 dismissed.
