NHS Norwich Clinical Commissioning Group (Health): ICO 30 Oct 2019

The complainant requested information from Norwich Clinical Commissioning Group (NCCG) regarding NHS pay banding for a specific NCCG role. NCCG refused to disclose the information citing section 40(2) (personal data) of the FOIA. The Commissioner’s decision is that NCCG was not correct to apply section 40(2) of the FOIA to withhold the information. The Commissioner requires the public authority to take the following steps to ensure compliance with the legislation. – To disclose the NHS pay banding for NCCG’s role of Governance and Operations Manager / Data Protection Officer. The public authority must take these steps within 35 calendar days of the date of this Decision Notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the FOIA and may be dealt with as a contempt of court.
