The MPS withheld the requested information under section 40(5) – personal information (neither confirm nor deny) of the FOIA. 2. The Commissioner’s decision is that the MPS is entitled to rely on section 40(5) to refuse to confirm or deny that it holds the information. 3. The Commissioner does not require the public authority to take any further steps.
