SIC Disability related expenditure – On 7 December 2012, Mr MacInnes requested from South Lanarkshire Council (the Council) a list of disability related expenditure accepted by the Council for the purposes of financial assessments over the previous 12 months. The Council withheld the information under the exemption in section 38(1)(b) of FOISA (personal data). Following an investigation, the Commissioner found that the Council had correctly applied the exemption in section 38(1)(b), being satisfied that the information comprised personal data the disclosure of which would breach the first data protection principle.
