In re M (a Child) (Contact Order): CA 11 Apr 2005

The father appealed against a suspended sentence of imprisonment imposed after he had been ten minutes late in returning a child.
Held: The judge had been wrong to involve the mother in deciding what was an appropriate punishment, and also wrong in thinking that a prison sentence even if suspended was appropriate because the father would be unable to pay a fine. The appeal was allowed and no punishment ordered.
