The court declined to strike out a claim by FKB for a declaration that certain patents were invalid as old, or obvious, as well as for an injunction against AbbVie Bermuda and AbbVie UK to restrain them from threatening or commencing proceedings for patent infringement in respect of acts covered by the declaration.
