Ferrier-May v Special Educational Needs Tribunal and London Borough of Ealing: Admn 3 Nov 1997

Gilliatt Appeal against decision of LEA to refuse to make a statement in relation to a child with dyslexia and the SENT which upheld the refusal. The LEA contended that the child was being adequately educated in his current school and no further assessment was required. In their decision letter the SENT made a number of references to the resources involved in preparing a statement whilst also giving cogent reasons for agreeing with the LEA. The court held that this did not amount to a primary focus on a legally irrelevant issue.
