The employee had claimed unfair dismissal, and the tribunal ordered a preliminary hearing to consider whether he had sufficient service. However at that preliminary hearing the tribunal found that though there was insufficient service, he was due payment in lieu, and awarded accordingly. No such claim had been made. The decision must be set aside, and the case was remitted.
