Dr Anjaneyulu v The General Medical Council (Appeal No 49 of 2001): PC 19 Dec 2001

(The Health Committee of the GMC) The doctor appealed an order extending his suspension from the medical register for a further period of twelve months. They considered that because of his continuing alcohol problems, he was not fit to practice. He had not complied with requests to be medically examined. When he later co-operated, he was seen to have minimised and lied about his use of alcohol. Nevertheless there was evidence of improvement.
Held: An appeal against a decision of the Health Committee is on a point of law only. The only possible point of law was whether a properly directed committee could come to this decision. It could, and the decision stood.
