Dispute between a group of neighbours who all live in a close of houses in Wimbledon. The close is subject to a building scheme, and the scheme contains a restrictive covenant which provides (among other things that are not relevant to this appeal) that the covenantor is ‘[n]ot to do or permit or suffer to be done anything on or about the property or buildings now or hereafter constructed thereon which shall or may be or grow to be an annoyance nuisance or disturbance to the Vendor the owners or occupiers of any other property on the estate.’
