The parties requested that a question be referred to the ECJ namely: ‘Are proceedings, in which a public authority alleges that an interest rate swap contract into which it has entered with a financial institution is invalid on grounds that it has exercised powers available to it (under its national administrative law as a public authority) to annul its resolutions to enter into that contract, a civil or commercial matter within the meaning of Article 1 of the Council Regulation (EC) No.44/2001 of 22 December 2000 ?’
