The department also cited sections 35 (formulation of government policy), 40 (personal information), and 41 (information provided in confidence). The Commissioner has decided that these exemptions have been incorrectly applied, and ordered that the report be released within 35 days. The department also failed to respond to the request within the twenty working day time limit.
