Cleland v Regina: CACD 16 Jul 2020

Referral by the Criminal Cases Review Commission – conviction on plea of attempted murder. Leave is sought to admit fresh evidence that at the time of the offence the appellant suffered Autism Spectrum Disorder (‘ASD’). On the basis of that evidence it is submitted that the appropriate sentence was, and is, a hospital order pursuant to section 37 of the Mental Health Act 1983 coupled with a restriction order pursuant to section 41 of that Act.
