The proposed respondent was a company of the Chinese State, with no base of business in the UK. Solicitors had represented them in other actions, and an order was made, to serve the papers on the solicitors. They contended that they had no instructions to accept service, and they had not been present at the application to make them authorised representatives under the Regulations. The concept of holding the solicitors to be such should not have been canvassed without them being given notice. The order was quashed and remitted to a differently constituted tribunal.
