ICO The complainant has requested copies of the drafting papers (i.e. instructions to Parliamentary Counsel and correspondence with Parliamentary Counsel) regarding specific provisions within the Finance Act 1994 and the Finance Act 2008. The Cabinet Office withheld the information on the basis of the legal professional privilege exemption (section 42) and the government policy exemption (section 35) of the Freedom of Information Act. The Commissioner’s decision is that the Cabinet Office is entitled to withhold the requested information on the basis of section 42. Information Tribunal appeal number EA/2012/0115 dismissed.
