The defendant sought permission to bring contempt proceedings against former directors of the claimant company, saying that by means of false evidence they had secured an arbitration verdict.
Held: A reckless disregard for the truth or falsity of a statement made and attested by a statement of truth but false was capable of supporting a finding of contempt of court. However in this case the evidence supporting the allegation of thefalsity of the statements made was not itself sufficiently strong to justify contempt proceedings.
In assessing proportionality, regard is to be had to the strength of the case against the respondents, the value of the claim in respect of which the allegedly false statement was made, the likely costs that will be incurred by each side in pursuing the contempt proceedings and the amount of court time likely to be involved in case managing and then hearing the application but bearing in mind the overriding objective.
