Further consideration of the circumstances in which the use of a hand-held mobile telephone when driving contravened s.41D of the Road Traffic Act 1988 and Regulation 110 of the Road Vehicles (Construction and Use) Regulations 1986. The appellant appeals by way of case stated from a decision of the Bexley Magistrates’ Court on 14 June 2021, convicting him of an offence under that Act and those Regulations.
The appellant was using his mobile telephone to change the music to which he was listening. The music was being played over the sound system in his car. His mobile telephone was paired with the car sound system via Bluetooth. The issue is whether this was an ‘interactive communication’ as required by the legislation for the offence to be committed.
