Attorney-General’s Reference (No 124 of 2008), Regina v Doran: CACD 11 Nov 2008

The AG appealed against a sentence of three years detention imposed for a burglary of a residence not using violence, but which was targetted against elderly people.
Held: The general tariff for such offences was five to six years where there had been a trial. Though it was right to reflect the general sentencing for burglary, those of private residences of the elderly should be treated more seriously than for example street muggings. The sentence was increased to four and a half years.
