The complainant made six different information requests between 30 June 2012 and 10 November 2012. West Felton Parish Council (council) refused to respond to the requests relying of section 14(1) of the FOIA as they deem the requests to be vexatious. The Commissioner’s decision is that the council is correct to rely on section 14(1) of the FOIA not to respond to the six requests. However, the Commissioner has found that the council has breached section 10 of the FOIA as they did not provide a response within the required timeframe. The Commissioner does not require the council to take any steps.
