Correct interpretation of Regulation 16(5)(c) of the Immigration (European Economic Area) Regulations 2016 (‘the 2016 Regulations’) which defines the circumstances in which a third country national who is the primary carer of a British Citizen (usually, though not invariably, a child) has a derivative right to reside in the UK. The 2016 Regulations ceased to have effect, save for certain transitional purposes, on 31 December 2020.
