The complainant has requested the council to disclose a certified copy of the full original Development Agreement dated 19 April 2011 and the related Deed of Variation dated 10 December 2013 in relation to the Blackwall Reach proposed regeneration. The council disclosed some information but refused to release other information citing regulation 12(5)(e) of the EIR. It is the Commissioner’s decision that regulation 12(5)(e) does not apply to the remaining withheld information. The Commissioner therefore requires the council to take the following steps to ensure compliance with the EIR: The council should disclose all remaining withheld information to the complainant.
