This pre-trial review is in a copyright action relating to a song called ‘Shape of You’ written by claimants (1) to (3), Mr Edward Sheeran, Mr Steven McCutcheon and Mr John McDaid. The song has been very popular and successful. The claimants brought the action for a declaration that they have not infringed any copyright of the defendants in a song called ‘Oh Why’, it having been suggested in correspondence that ‘Shape of You’ had infringed that copyright.
