Saint Francis Hospice v Burn: EAT 13 Aug 2013

EAT Employee resigned in response to ‘last straw’ communication from employer during a period of ill-health absence. Employment Judge finds employee was constructively unfairly dismissed. Employer’s appeal puts in issue correctness of findings on liability and quantum. Appeal allowed only in respect of one element of compensatory award. Otherwise, the Judge’s judgment contained a correct application of the law to her ample findings of fact.
