EAT DISABILITY DISCRIMINATION – Reasonable adjustments
The Claimant had surgery for parotid cancer in 1998 and so was disabled under para 6A Disability Discrimination Act 1995. In 2009 he developed symptoms in his back which the treating physicians did not immediately link to the cancer. He died in 2011. The Respondent did not know, and could not reasonably be expected to know of the link and so was not in breach of the duty to make reasonable adjustments for the symptoms in his back.
