Northern Lincolnshire and Goole Hospitals NHS Trust (Decision Notice): ICO 18 May 2006

On 16/02/05 the complaint requested a copy of the ‘specific zero tolerance and or withdrawal of treatment’ policy, relevant to withdrawal of his treatment in 2002. Northern Lincolnshire and Goole Hospitals NHS Trust (the Trust) supplied a number of policies of relevance to the complainant’s request, but could not provide a ‘specific’ policy. It was explained that no such policy was held at the time the complaint’s treatment was withdrawn. Following an investigation, the Commissioner is satisfied that the information the complainant requested could not be provided as the ‘specific’ policy required was not in place at the time of the withdrawal of his treatment in 2002. The Trust has supplied the current policy and other documentation of relevance. Accordingly, the Commissioner has judged that the public authority dealt with the request in accordance with the requirements of the Act. The Information Tribunal has ruled on this decision and has upheld this appeal.
