The complainant requested information relating to a review of sentencing policy. The Ministry of Justice (MoJ) refused to provide the requested information, citing section 35(1)(a) (formulation of government policy) of the FOIA. The Commissioner’s decision is that the MoJ was entitled to apply the exemption at section 35(1)(a) of the FOIA and that the public interest favoured maintaining the exemption. The Commissioner requires no steps to be taken as a result of this decision.
