At first instance (see BL O/235/07) the Hearing officer had found the opponents successful under Section 5(2)(b).
The applicant appealed to the Appointed Person, claiming that the Hearing Officer had been wrong in his finding of similarity in the respective products. The Appointed Person, however, upheld the decision of the Hearing Officer.
