The appellant applied for leave to issue judicial review proceedings seeking a declaration that the decision of the Prime Minister on 24 January 2020 to sign the ‘Agreement on the Withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community’ (‘the withdrawal agreement’), including the Protocol on Ireland/Northern Ireland (‘the Protocol’) was unlawful in that he did not intend that the UK Government would be bound by or adhere to or otherwise fully implement that agreement.
