Hothi v Stokes: ChD 15 Aug 2022

The Claimant commenced proceedings against the Defendant in relation to the boundary dispute, seeking an injunction to restrain the Defendant from preventing the reinstatement by the Claimant of a fence along what was said by the Claimant to be the correct line of the boundary between the two properties. Damages were also sought for trespass, including exemplary damages. The Defendant defended the proceedings and counterclaimed for declaratory relief and damages.
