The Home Office disclosed most of the requested information, including information about individual amounts claimed, but it withheld copies of receipts submitted in support of subsistence claims. It said this information was exempt under section 40(2) (personal information) of the FOIA. The Commissioner’s decision is that the Home Office was entitled to rely on section 40(2) of the FOIA to withhold the receipts. However, she found that it breached section 1 and section 10 of the FOIA by failing to respond to the request within the statutory time for compliance.
